Terms of Service

1. Service Description

KinectB2B ("we," "us," or "our") provides B2B lead generation, prospect research, and automated outreach services to service-based businesses ("Client" or "you"). Our platform identifies qualified prospects within your designated service territory, builds verified contact lists, and executes professional multi-channel outreach campaigns on your behalf.

2. Territory Exclusivity

Each Client is granted exclusive rights to their designated territory and industry for the duration of their active subscription. We will not onboard a competing business in the same industry within your territory while your subscription is active. Territory boundaries are defined during onboarding and documented in your account profile.

Territory exclusivity applies only to your specific industry. We may work with businesses in different industries within the same geographic area. Exclusivity is non-transferable and terminates upon cancellation of your subscription.

3. Payment Terms

Subscription fees are billed monthly in advance on the anniversary of your subscription start date. All fees are quoted in U.S. dollars. Payment is processed via Stripe. You authorize us to charge your designated payment method for all applicable fees.

  • Plan upgrades take effect immediately with a prorated charge for the remainder of the billing cycle.
  • Plan downgrades take effect at the start of the next billing cycle.
  • Failed payments will be retried up to three times. Accounts with unpaid balances may be suspended after 7 days.

4. Cancellation Policy

Either party may cancel the subscription with 30 days' written notice. Notice may be provided via email to accounts@kinectb2b.com or through your client portal. Upon cancellation:

  • Your service will continue through the end of the current billing period.
  • No refunds are issued for partial months or unused portions of the billing cycle.
  • All active outreach campaigns will be paused and wound down professionally.
  • You will retain access to your client portal and lead data for 30 days after the end of service.

5. Lead Data Ownership

Leads and prospect data generated through our service on your behalf belong to you. Upon request or cancellation, we will provide a complete export of your lead data in a standard format (CSV).

KinectB2B retains the right to use anonymized, aggregated data derived from campaign performance (e.g., open rates, reply rates, industry benchmarks) to improve our services. No personally identifiable information about your prospects will be shared with third parties or other clients.

6. Results Disclaimer

While we are committed to delivering the highest quality outreach and lead generation services, we do not guarantee specific results, including but not limited to a minimum number of leads, appointments, or revenue outcomes. Campaign performance depends on many factors including your industry, territory, offer, and market conditions.

We commit to best-effort execution, continuous optimization, and transparent reporting of campaign performance. If results are below expectations, we will work with you to adjust targeting, messaging, and strategy at no additional cost.

7. Acceptable Use

You agree to:

  • Provide accurate business information during the application and onboarding process.
  • Respond to qualified leads and appointment requests in a timely and professional manner.
  • Not use our platform or data for purposes other than legitimate B2B outreach.
  • Comply with all applicable laws regarding electronic communications, including CAN-SPAM and state-level regulations.
  • Not resell, redistribute, or share lead data generated through our service.

8. Limitation of Liability

To the maximum extent permitted by law, KinectB2B's total liability arising from or related to these terms or the services shall not exceed the total fees paid by you in the three months immediately preceding the event giving rise to the claim.

In no event shall KinectB2B be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, regardless of the theory of liability.

9. Modifications

We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
